When we photograph at public venues or commercial properties, individuals may have limited expectations of privacy in common areas under applicable U.S. law.
Important clarification: Venue/restaurant signage, venue policies, or venue-recording notices may define what the venue may do (e.g., record or use media for venue purposes). Such signage/policies do not grant ABC Photoshoot the right to use identifiable images for our marketing unless we obtain separate written authorization.

To the maximum extent permitted by law:
A) No liability for travel supplier performance (intermediary-only).
For any travel-related services, ABC Photoshoot (and/or our host agency and affiliates) acts only as an intermediary/booking facilitator. We are not liable for supplier acts/omissions, failures, defaults, cancellations, delays, schedule changes, insolvency, or any travel outcomes.
B) Photography/video liability is limited.
For photography/video/creative services, our liability (if any) is limited as set forth below and excludes consequential damages.
C) No punitive/exemplary damages.
YOU WAIVE ANY RIGHT TO PUNITIVE, EXEMPLARY, OR MULTIPLIER DAMAGES, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
D) No indirect damages.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
E) Liability CAP.
If ABC Photoshoot is found liable for any claim (including photography services), our total aggregate liability will not exceed the total amount you actually paid to ABC Photoshoot for the specific service/booking giving rise to the claim (including any service fee), or $500, whichever is less, unless prohibited by law.
You agree to defend, indemnify, and hold harmless ABC Photoshoot LLC and its owners, contractors, employees, affiliates, and host agency (where applicable) from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from:

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law rules.
THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to this Agreement, the website, or our services (including travel services) will be resolved by binding arbitration, not in court, except as stated below.

Arbitration is only individual; no consolidation.
30-Day Opt-Out:
Email Luka@abcphotoshoot.com within 30 days of first acceptance. Subject "Arbitration Opt-Out." Include name, email, phone, and clear opt-out statement.
You may bring claims only in your individual capacity, not as a plaintiff or class member in any class/collective/representative action. The arbitrator/court may not consolidate claims or preside over a class action.
If unenforceable, arbitration may be void only to the extent required by law.
ABC Photoshoot LLC (Independent Travel Advisor through InteleTravel Host Agency)
Valid as of January 1, 2026
By making any payment to ABC Photoshoot for travel-related planning, booking, advisory, concierge, or related services, and/or participating in any travel arrangement we facilitate (a "Trip"), you agree to these Travel Terms, supplier terms, and Host Agency (InteleTravel) terms (collectively, the "Travel Agreement").
ABC Photoshoot LLC acts as an independent travel advisor through InteleTravel ("Host Agency"). For many bookings, the Host Agency may be the agency of record with suppliers.
We act only as an intermediary to facilitate bookings with independent suppliers. We do not own or control any supplier.
Travel involves variables outside our control. You acknowledge:
ABC Photoshoot charges a professional service fee for planning, research, itinerary design, booking assistance, modifications, concierge coordination, and communications ("Service Fee").
Payment due dates are stated on your invoice/confirmation. Late payment may cause cancellation and supplier penalties.
Reservations are generally non-transferable unless supplier-approved in writing.
All travel services are governed by supplier terms. Refunds/credits/rebooking (if any) are controlled by suppliers. ABC Photoshoot cannot override supplier decisions.
Changes may trigger supplier fees/fare differences and additional Service Fees for added work/time.
Supplier cancellation penalties apply regardless of reason. Service Fee remains non-refundable. Refund timelines depend on suppliers/processors.
Suppliers may cancel/change/fail to deliver services. Supplier default (insolvency/bankruptcy) may result in loss of payments with limited remedies. ABC Photoshoot is not responsible for supplier default.
We assume no liability for loss or disruption due to events beyond our control including hurricanes, storms, natural disasters, pandemics, government actions, border closures, war/terrorism, labor disruptions, carrier shutdowns, and infrastructure failures. Suppliers may offer credits instead of refunds.
You are solely responsible for passports, visas, health documentation, minor travel documentation, and compliance with laws and entry rules. Denied boarding/entry may result in no refund and no liability for us.
We strongly recommend travel insurance including cancellation/interruption, medical, evacuation, and supplier default coverage where available. If you decline, you accept increased risk.
Suppliers may deny service or remove travelers for policy violations or safety reasons without refund. You are responsible for resulting costs and any damages you cause.
Travel disputes are subject to Binding Arbitration & Class Action Waiver (Part B).

ABC Photoshoot does not use identifiable client images for our marketing without written authorization (release or explicit written agreement). Venue notices/signage do not grant ABC Photoshoot marketing rights.
We use cookies for functionality and analytics; you can control them in browser settings.
Reasonable safeguards are used. Data is retained as needed for operations, compliance, disputes, and enforcement.

Before initiating any chargeback or payment dispute, you agree to contact us in writing at Luka@abcphotoshoot.com and provide reasonable details and supporting documentation, and allow us at least 10 business days to investigate and attempt resolution.
Initiating a chargeback after receiving services, deliverables, confirmed bookings, or planning work (including travel research/itinerary work) may constitute an unauthorized chargeback and a material breach of this Agreement.
You authorize ABC Photoshoot and its processors/host agency (as applicable) to submit evidence to contest a chargeback, including:
If a chargeback is filed in violation of this Agreement, you agree to reimburse ABC Photoshoot for:
We may suspend access to galleries/accounts and refuse future service until all balances are paid.
If we reasonably suspect fraud, identity misuse, or misrepresentation, we may cancel service, suspend access, and report information to processors or relevant authorities as permitted by law.
This Agreement constitutes the entire agreement between you and ABC Photoshoot regarding the website and services and supersedes prior discussions to the extent they conflict.
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
Sections relating to intellectual property, privacy, limitation of liability, indemnification, arbitration, class action waiver, chargebacks, and governing law survive termination.
We may assign this Agreement in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign without our written consent.
Failure to enforce any provision is not a waiver of future enforcement.
